FAYETTEVILLE, Ark. -- Former Arkansas defensive lineman Jermaine Brooks pleaded innocent Monday to seven felony counts of drug and weapons charges filed after police allegedly bought marijuana from him at his off-campus apartment.
Prosecutors also added a pair of charges against Brooks -- two counts of theft by receiving. Two handguns found in his apartment during a raid Oct. 22 had been stolen, the Washington County prosecutor's office said.
Brooks' only comment to the judge was his innocent plea. A trial was set for Jan. 29 before Washington County Circuit Judge William Storey.
After his arrest last month, Brooks apologized to Arkansas football fans in a telephone interview with a television station.
''Tell everyone I made a mistake, a big mistake,'' Brooks told Fort Smith TV station KPOM. ''I would like to tell all Razorback fans, Razorback teammates, family, friends and especially the coaching staff that I am truly sorry.''
Deputy prosecutor John Threet said Monday no plea agreement was discussed before the arraignment, but that it likely would be discussed before the trial date.
''It's very rare when it's not, regardless of the type of case,'' Threet said.
W.H. Taylor, Brooks' defense attorney, said ''no one knows at this point'' on the question of a possible plea agreement. Taylor, a Fayetteville attorney, wouldn't comment further on the case.
Brooks previously had been charged with the sale or possession of 10½ pounds of marijuana. During the raid, officers also seized several guns and nearly $17,000 in cash.
A woman arrested with Brooks at the time of the raid, Razorback Belle Auburn Celeste Williams, will not be charged, Threet said.
''We don't feel that she was involved in any of the crimes we're alleging he was committing,'' Threet said.
Brooks faces charges alleging drug possession, drug distribution, simultaneous possession of several rifles and handguns and theft by receiving.
Arkansas coach Houston Nutt kicked Brooks off the team after learning of the arrest. Brooks, a co-captain, graduated last May in industrial technology and started work on a graduate degree.
Police seized 7½ pounds in the raid and said Brooks had sold three pounds of marijuana out of the apartment in the previous week.
Brooks, 22, of Pasadena, Calif., had started all six games for Arkansas before his arrest. Last season, Brooks started seven of 11 games and had 56 tackles.
Earlier this year, defensive back Ken Hamlin served nine days in jail for a second offense driving while intoxicated charge. Running back Cedric Cobbs was sentenced to 20 hours of community service, six months of probation and fined $700 for marijuana possession, driving while intoxicated and speeding. Both remained on the team. |
