SALT LAKE CITY -- Former NBA player and Jazz center Olden Polynice was fined $450 and ordered to get anger management therapy for yelling obscenities at a prosecutor.
Polynice, 38, pleaded guilty Friday to disturbing the peace for the hallway confrontation with Holladay city attorney Lohra Miller when she was prosecuting him for a golf-course assault.
Polynice was back in court Friday, a day after he finished two days in jail for assaulting the golfer. That conviction violated terms of a plea bargain Polynice made for a previous conviction of impersonating a police officer, his lawyer Greg Skordas said Saturday.
City Justice Court Judge Virginia Ward also sentenced Polynice to six months probation for the December yelling incident.
"You may not chase a public official down the hallway yelling obscenities. It makes the community uncomfortable,'' Ward said.
Polynice told reporters his troubles with the law were over. "From now on, I'll just run away from situations,'' he said.
On Thursday, another judge fined Polynice $1,850 and ordered him to perform 240 hours of community service for assaulting the golfer in July 2001.
On Friday Polynice had to be prodded by his lawyer to plead guilty to disturbing the peace, an infraction, for his confrontation with the prosecutor.
"You plead guilty. Right, Olden?'' asked defense attorney Greg Skordas.
"I don't feel good about it, but I plead guilty,'' Polynice said.
He told the judge he was offended when Miller called him "an angry black man'' during the golf-course trial last December. Miller maintained she referred to him only as an angry 7-foot man. In the hallway, she said Polynice said he hated living in Utah. She replied, "Then why don't you leave?''
Polynice on Friday used that reply to complain that Miller was "telling me I'm not welcome here and that I ought to get out of Salt Lake City. I was offended. I am an American. I have rights, too. I refuse to be run out of this city. I love this city. There are some good people here.''
Polynice, married with four children, lives in the Salt Lake City suburb of Holladay and plays for a Continental Basketball League team.
He played for Utah, Seattle, Los Angeles, Detroit and Sacramento during 14 seasons in the NBA. He attempted an NBA comeback last fall after signing with Philadelphia but was waived before the season opened.
Polynice was convicted of a class B misdemeanor for attacking Tyler Swensen at the Old Mill Golf Course on July 23, 2001. Polynice admitted "mushing'' Swenson in the face during the incident, but denied any assault.
Swenson testified that he tried to apologize to Polynice about an errant tee shot by a member of his foursome, but the 7-foot, 250-pound Polynice pushed him, punched him in the kidney and spit in his eye. |
